The Therapeutic Products Advertising Act (Heilmittelwerbegesetz, HWG) regulates advertising for medicines, medical devices, and other health-related agents, procedures, and treatments, regardless of which channel the advertising appears on. An Instagram post is therefore generally subject to the same rules as a traditional ad, while pure image advertising with no reference to a specific product or procedure generally doesn't fall under the HWG.
For pharmacies, this means in particular that prescription medicines may not be advertised to the general public (Section 10 HWG), and misleading statements or unsubstantiated claims of effect are prohibited (Section 3 HWG). Advertising for unapproved medicines or unapproved uses is also prohibited (Section 3a HWG). Medicine advertising must also observe the required mandatory disclosures (Section 4 HWG). Further rules cover promotional gifts, free extras, and discount promotions (Section 7 HWG), as well as certain forms of public-facing advertising (Section 11 HWG) — for example, fear-based advertising, advertising aimed predominantly at children under 14, or certain endorsements and case histories.
